His day parole was further extended in February 2022 and again in August. A two-member parole board panel has now approved full parole after the day parole expires in November.Day parole extended Cape Breton man convicted of second-degree murder; full parole hearing ordered MacKeigan first strangled Smith before covering her body with vehicle tires and setting it ablaze. The victim’s teeth were also removed. Identification was confirmed by matching DNA from Smith's children.

“Based on your most recent period of stable day parole performance, including a positive intimate partner relationship and transparent reporting in a timely manner, your case management team now supports full parole being granted,” said the panel in its decision adding that local police were not opposed to MacKeigan's release.
