On the day of their flight, Feb. 15, Mia Mackoff told staff she had tested positive on Feb. 5 and was therefore allowed to fly on Feb. 15 without presenting a negative COVID test. The Mackoffs told the Air Canada website itself noted that someone testing positive on Jan. 1 would be able to fly Jan. 11.

“I find Air Canada’s agents caused the applicants’ extra expenses by misinterpreting the COVID-19 travel restriction policy,” she wrote.Article content Mr. Mackoff, a retired lawyer, asked the tribunal to also award him and his wife $2,400 each under Canada’s Air Passenger Protection Regulations that compensate passengers when they’re bumped from a flight because of overbooking.
