Warriner had gone to the hospital with a cough and shortness of breath on May 10, 2020. She suffered from chronic obstructive pulmonary disease and when she arrived, she was treated as though she was COVID positive, CBC reported.Article content “But for her interaction with the Applicants, Ms. Warriner would likely be alive today,” a forensic pathologist testified at the preliminary hearing. The defence disputed this.Article content
The judge, in dismissing the case, said, “there is no evidence that either accused applied any weight to the upper body … beyond that associated with gaining control of and holding her hands or arms while handcuffs were being applied.”
