Telus has filed a motion to quash the document production demands in the subpoenas, according to filings posted on the Competition Tribunal’s website, and the commissioner’s filing said he is in agreement with the relief sought by Telus.
“The Tribunal should not allow subpoenas to be used as a fishing expedition,” said the Oct. 17 filing titled Response of the Commissioner, in which the competition watchdog argues that the subpoenas are “overbroad and unnecessary” and, furthermore, contain requests for some documents Rogers and Shaw already have.“Any responsive documents not already in Rogers and Shaw’s possession are unlikely to be relevant and material to the issues the Tribunal must decide.
“That campaign has included persistent efforts to persuade all of the CRTC, ISED and the Competition Bureau — the principal regulators with supervisory responsibility over the telecommunications industry and competition in Canada — to block the Proposed Transaction.” The two subpoenas on Telus by Rogers and Shaw were directed at Nazim Benhadid and Charlie Casey, according to the filing. LinkedIn profiles matching those names belong to Telus vice-presidents of planning and engineering, and finance, respectively.
