“The subpoenas describe documents in broad, sweeping terms and would only serve the purpose of fishing in hopes of finding relevant information,” says an Oct. 17 filing made public late Tuesday by the Competition Tribunal, which will hear the Competition Bureau’s challenge of the merger beginning next month.Sign up to receive daily headline news from the Calgary SUN, a division of Postmedia Network Inc.
“The Tribunal should not allow subpoenas to be used as a fishing expedition,” said the Oct. 17 filing titled Response of the Commissioner, in which the competition watchdog argues that the subpoenas are “overbroad and unnecessary” and, furthermore, contain requests for some documents Rogers and Shaw already have.
“Bell and TELUS are direct, head-to-head competitors of each of Rogers, Shaw and Videotron. From virtually the moment the Proposed Transaction involving Rogers and Shaw was announced publicly in mid-March 2021, Bell and TELUS have engaged in a closely coordinated, multi-faceted campaign to derail the Proposed Transaction in an effort to advance their own commercial interests,” Shaw said in the filing.
The Shaw document also says the telco “repeatedly” invited lawyers for Bell and Telus to meet to address any “legitimate” concerns” with the subpoenas, including narrowing their scope, but that lawyers for the rival telcos “did not accept any of those repeated invitations prior to the end of the day on Thursday, Oct. 13, 2022.”Article content
