Councillors have simply kicked the problem down the road and let both staff and the real\u002Destate companies off the hook.

Unfortunately, the motion carried by council does not cite section 6 of the Act, which allows municipalities to apply to the Normal Farm Practices Protection Board for a determination of whether or not staff interpreted the agricultural exemption correctly. This matters because without a determination from the board, staff and the parties involved in the deforestation cannot be held accountable.

Responsibility for destruction of a large forest ecosystem, including the animal and plant species that inhabited the space, may be left dangling and the possibility of consequences forgotten. The ambiguity arising from the situation is big enough to drive a logging truck through. Can a real-estate and housing development company claim to be a farm operation for the purpose of exempting itself from a municipal bylaw? Is logging a normal farm practice? Asin the Ottawa Citizen even before the recent council meeting, “staff’s action may have set a dangerous precedent.”

The risk of pre-emptive deforestation by anyone with land along the urban boundary remains painfully unaddressed. Council has given staff until the fall to come back with some ideas on how to fill the big hole in the Tree Protection Bylaw. Much more time after that will be needed to actually change the bylaw and get it passed by council.

Council did not step up to show the public, and the city’s own bureaucracy, how it holds parties accountable. Rather, it has kicked the problem down the road and let both staff and the real-estate companies off the hook. The harm done remains repeatable — all through the long, hot summer to come.
