It’s been two and a half weeks since the independent commission tasked with examining Prime Minister Justin Trudeau’s unprecedented invocation of the Emergencies Act began holding public hearings.
It’s undoubtedly a useful lens through which to assess the latest developments but one that requires a sweeping caveat: namely, that there’s no guarantee that Commissioner Paul Rouleau will draw any conclusions on whether the move was justified, either in law or as a matter of public interest. At this point, it’s necessary to attach a caveat to that caveat: as this inquiry is unprecedented — like everything connected to the use of the act — there’s no record to check to get a sense of what to expect from the final report. When Process Nerd put her query to the commission itself, she was politely but firmly directed to the order in council outlining its mandate, as well as Rouleau’s opening statement.
