A self-admitted cocaine dealer facing a “formidable” case has been cut loose by a judge who found Toronto police stole about $6,000 in cash seized from his Weston Road apartment.
“I am satisfied on a balance of probabilities that the money was taken by one or more police officers involved in the investigation,” Justice Andras Schreck wrote in a pretrial ruling released Wednesday.
“The justice system worked as it should — because the rest of the system in this case certainly didn’t,” defence lawyer Kim Schofield said on Wednesday. Schofield said the officers themselves exposed the theft by taking photos showing large stacks of cash at the apartment that shrank to smaller bundles after they were taken to the police station.Prosecutors argued the defence was wrong to claim police stole any money and the main money handler testified he did nothing wrong other than make several clerical errors in processing the cash.
The judge also found the defence’s efforts to recreate the bundles with their own cash — based on the police description of the denominations seized — were also compelling evidence of missing funds.The judge said he was not prepared to make a specific finding with respect to the thief’s identity.
