The POEC is mandated to determine if the federal government met the legal threshold when it controversially invoked the act on Feb. 14 to deal with the convoy protests across the country. The act states it can only be used when no other law provides the necessary powers to deal with a national crisis.
Text messages show that the federal Minister for Public Safety, Marco Mendicino, was very intent on being seen in Windsor on Feb. 15, the day after the blockade at the Ambassador Bridge was cleared.“Not appropriate. Optics are terrible. Can we stop it?,” reads a text message from OPP deputy commissioner Chris Harkins to Carrique.
Thursday, Carrique testified that the power to compel tow truck companies to assist police was not necessary because they had already signed on dozens of trucks. But when grilled by a government of Canada lawyer, he admitted that when the OPP was granted the power to compel tow trucks to help, they did.
