Local advisory group says the complicated legal position of sex work in Canada needs clarity for the safety of the people in the trade and their clients, and they hope a trial currently ongoing in a Toronto courtroom will settle the matter for good

The Canadian Alliance for Sex Work Law Reform began presenting arguments last week in a landmark Superior Court hearing that they hope will lead to the full decriminalization of sex work in Canada.

At the time, states the alliance in a press release, the Liberal government promised to repeal PCEPA. However, “seven years later they have failed to act and sex workers have been forced to work in the context of criminalization causes harm to their lives.” “There are three goals to PCEPA,” said Gregory. “To reduce the demand for prostitution, reduce entry into prostitution and to completely abolish prostitution.”

The alliance is challenging the PCEPA laws based on the harms that criminalization brings to their lives, and the charter rights that are violated, including the right to life, liberty and security, the right to equality and non-discrimination, the right to freedom of expression and the right to freedom of association.

Gregory offers the example of a client who notices something is off with a sex worker he has engaged for services, beleiveing she may be trafficked. However, the client is unable to report the situation as it is they who will be prosecuted under the existing laws. If PCEPA is struck down, the client could report to police without consequence. The same for any sex workers who are victims of sexual assault or violence and currently cannot report to police for fear of prosecution.

In essence, she must spend more time protecting her clients from police than she does protecting herself from clients.
