Court of King\u0027s Bench Justice John Henderson acquitted Mathew Blachford of second\u002Ddegree murder in the death of Victorine Jennifer Donovan
The Crown had no direct evidence Blachford was the killer. However, prosecutor Jeff Rudiak successfully argued that surveillance footage placed Blachford in the Nova Terrace parking lot at the time of Donovan’s murder.
However, Henderson said those facts did not prove Blachford was the killer. Donovan was killed in a high-density residential area with multiple points of entry, and Blatchford did not have exclusive opportunity to commit the murder. The blood and DNA on Blachford’s jeans were also inconclusive: an RCMP analysis of the material found the presence of Donovan’s DNA, but could not conclude whether the blood spatters themselves were human or animal.
Henderson put even less stock in the DNA found on Blachford’s car. He said the odds Donovan’s DNA would have landed on the Avenger during her murder were “extremely remote,” given it was parked 60 to 80 feet from where she was beaten and shot. There was also no evidence the DNA on the car’s exterior came from blood. Henderson noted Blachford and Donovan met regularly to conduct drug transactions, giving ample opportunity for her DNA to end up on the car indirectly through a touch or a sneeze.
