The current debate over the proper balance between the legislature and the courts is a sign of a healthy democracy

This is not the first time the court has ruled that a cabinet minister must be dismissed — or the first time Deri has beenof the controversy. In the early 1990s, while serving as interior minister in a coalition led by Prime Minister Yitzhak Rabin’s Labor party, Deri came under investigation for allegedly abusing his position and committed to stepping down if he was indicted in court.

The case set two important precedents: it was one of the first controversial uses of the “reasonableness test,” which the government now aims to eliminate, and it cemented the power of the attorney general to be the final arbiter of what the government can present to the court . Back then, it was the left that was furious over the court’s use of the reasonableness test to override a political decision that was not in violation of the law and, in that case, was made before any wrongdoing was proven in court. The court has since used its veto over Supreme Court nominees to prevent at least one left-wing critic of the court’s review powers from being appointed to the bench.Article content.
