Florida governor right to be angry over misleading attacks on education law, but free speech conservatives shouldn\u0027t applaud retaliation
Being the de facto government in the area gave Disney tremendous power over how and when its lands would be developed without the kinds of interference or regulation that other businesses in Florida might endure. After all, if you control the local government, you get to approve your own zoning applications, dictate where roads will be built, and determine what rate of tax you’ll pay. Don’t like a public official? Fire him at the next meeting.
Unfortunately, Governor DeSantis showed he can hold a grudge. And, being an undeclared candidate for president required that he show prospective Republican voters he was on their side in the culture wars. So DeSantis and the Republican-led legislature made good on their promises to punish Disney. They passed a special law dissolving Reedy Creek. In its place, they created a new entity whose board would be appointed by the governor, rather than Disney.
This past week, Disney responded by filing a lawsuit in the Florida federal court that alleges that the new board’s action violates the U.S. Constitution. Disney contends that voiding the contracts was punishment for its having expressed a political opinion with which the government disagreed. It makes claims under the Contracts Clause, the Takings Clause, the Due Process Clause, and the First Amendment.
