In a recently released decision, the labour relations board upheld the firing as a valid step “in light of the seriousness of the misconduct.” It found Viner did some hospital work during regular business hours, used government resources to support that work, took unauthorized leave, and sent confidential government information to his personal email account.

The Professional Institute of the Public Service of Canada, which represented Viner, said it would not comment on the decision. Viner could not be reached for comment Tuesday. The investigation also uncovered 11 insecure emails containing protected information, plus one with a password and username. Dr. Klein said government physicians followed an honour system and were expected to make up any time lost to their outside activities.
