A Gardiner application was abandoned on March 29. A Gardiner hearing involves evidence being called after a guilty plea has been entered, during sentencing, about aggravating or mitigating facts that are in dispute. Thibault committed the offences in Kentville on Feb. 6, 2019. Another count of assaulting a peace officer engaged in the execution of his duty and a charge of possessing a weapon, a knife, for the purpose of committing an offence were dismissed on April 20.Intermittent custody for impaired driving
Whynder was found guilty on the impaired driving charge. A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both was stayed. A charge of failing to stop his vehicle as soon as was reasonable in the circumstances while being pursued by a peace officer was dismissed.
The court imposed a two-year driving prohibition against Whynder, and he was fined a $100 victim surcharge. Whynder will be on probation while not in confinement.
