Robert Charles Rogers is standing trial, accused of second-degree murder
The Yarmouth Justice Centre. TINA COMEAU PHOTOA note to readers: This story contains some disturbing details.
The day began with lengthy instructions made to the 14-member jury by Justice Pierre Muise. He reminded the jurors that Rogers is presumed to be innocent and that it is not up to the accused or the defence to prove his innocence. Rather the onus is on the Crown to prove Rogers’ guilt beyond a reasonable doubt.Crown Attorney Bob Morrison delivered the Crown’s opening statement, outlining what he and fellow Crown Attorney Saara Wilson intend to prove during this trial.
The Crown – previously saying that Rogers had committed an indignity on Cook’s remains – said the evidence will show that Rogers used a chainsaw to cut the victim’s legs off. “Inside that car was a shotgun that was later identified as the shotgun that was used to shoot Colton Cook,” Morrison said during his opening statement. “On Sept. 30, Mr. Rogers left a note at the home of Keith Siscoe Jr. The note read: ‘I am responsible for the death of Colton Cook,’ signed by Bobby Rogers.”
He described Cook’s white truck that he drove and said when the two parted ways that night his friend was happy. He said they had been drinking. He told the court Cook had taken two shots of vodka from a pint that Cook had. He said Cook wasn’t drunk that night when they were together, and that Cook had talked about trying to meet up with a girl, whose name Amon didn’t know.
The next witness to testify was Anthony Smith, a neighbour of the residence that Rogers, Crawford and Siscoe were staying in. He testified to being awoken on Sept. 26, 2020, at around 4 a.m. by the loud sound of a vehicle revving and the sound of a chainsaw. He said both went on for some time.
