“This action can only, in my view, be considered vengeful intensification by Mr. Marcellin . . . I do not believe the court should permit it to continue. In the context of this particular case, highly acrimonious family law matters ought not to diverge into defamation actions,” Nicholson wrote in his decision released Tuesday.Article content
“This decision stands for an important precedent that lawsuits that are brought to intimidate and silence victims and their supporters should be dismissed,” Miller said. Woodstock police say an officer conducted a thorough investigation into Marcellin’s allegations, concluding there were insufficient reasonable and probable grounds to support charges, a position backed by the Windsor Crown Attorney’s office after it reviewed the file, according to a statement of defence.
“Both sides argued that the peace bond and withdrawal of the charges supported their narrative. There was no guilty plea nor findings of guilt, so the outcome of the charges cannot be evidence of guilt, in my view. Neither can the outcome be considered an exoneration. At best, the resolution of the criminal charges is a neutral factor,” he wrote.
