The Supreme Court of Canada struck down a law requiring repeat sex offenders be automatically included on the sex offender registry for life.

But in what rational view of our justice system — particularly in the era of the #MeToo movement, recognizing the crime of sexual assault for the abhorrent offence it is — did requiring that sexual offenders convicted of more than one offence be placed on the sex offender registry for life, become an abhorrent concept?

This is the latest example of the Supreme Court and lower courts dismantling laws passed in the Harper era that reduced the discretion of judges in passing sentences, not only with this law but others which, for example, imposed mandatory minimum sentences on gun crimes.Prime Minister Justin Trudeau and the current Liberal government take a similar view, passing legislation to eliminate mandatory minimum sentences passed in the Harper era on a number of gun crimes.

Ironically, when Harper was poised to win the 2006 federal election, ending 13 years of Liberal government, he predicted his Conservative government would be reined in by senators, civil servants and Liberal-appointed judges. In the end, it didn’t matter whether the judges were appointed by Liberals or a Conservative government in the nine years Harper was in power.
