“The applicants overstate the extent of the privilege … there is no blanket privilege to decline to testify,” commission lawyers argue in a memorandum of fact released Monday. “Parliamentary privilege prevents members of the Ontario Legislative Assembly from being compelled to testify in any proceeding while the legislature is in session and for 40 days before and after each session. This includes periods where the house is adjourned,” they state in a legal motion filed last week.
“If comply with the summonses, the only inconvenience for the Ontario Legislative Assembly would be to ‘deprive’ it of the presence of the applicants at the assembly on a day it is not sitting,” it said. “Public inquiries are the antithesis of vexatious litigants who could stifle the ability of the members of the assembly to attend the Legislative Assembly.”
Government house leader Paul Calandra reiterated Monday that “of course it is a federal inquiry” and the Queen’s Park is co-operating, but the premier and his minister need not appear.
