“She’s not an adult , she’s 16 years old,” Spark told the appeals judges in arguing Ibrahim’s conviction in the Feb. 9, 2015, attack should stand. “The appellant has not shown that the trial judge in this case erred in his assessment of the credibility and reliability of the complainant and the appellant,” the appeal justices said in their written decision.Article content
“The appellant points to errors in the complainant’s testimony. None of these errors however are material,” they said. “Errors such as which franchise of gas station the complainant and were picked up from, who told her to remove her clothes, when she started crying and whether the appellant had finished having sex with her when the police arrived were not essential in the reasoning process resulting in the conviction.”
