Kayley Perry and her kids might be homeless soon. The single mom of three kids is facing homelessness after the Island Regulatory and Appeals Commission upheld a decision to evict her from her apartment. | SaltWire
Charlottetown resident Kayley Perry says she and her kids are losing their home after multiple neighbours filed complaints to her landlord – complaints she says are unfounded – which resulted in her being evicted. - Cody McEachernCHARLOTTETOWN, P.E.I. — A P.E.I. woman says she and her kids are facing homelessness after the Island Regulatory and Appeals Commission upheld a decision to evict her from her apartment.
“I guess I started making some bad friends around here who don’t really like me,” she said. “I got accused of assaulting this family and a bunch of ridiculous claims of things I absolutely would not do.”'I’m fighting this until the end:' Summerside hotel residents receive second eviction notice, given 30 days to move
Perry said that accusation, like the others, was made without any evidence it had happened, noting that the neighbour was likely using a past DUIThe complaints, Perry said, began after she and her neighbour had a personal falling out late last year. She said she began hearing about the complaints shortly after that.
Morgan Sandiford, Legal Navigator with Renting P.E.I., says P.E.I.'s rental office uses a different method to determine truths than what is seen in courts. He says often, the office will look at what is most likely true, which can be based on the volume of complaints instead of whether the complaints are factually true. - SaltWire Network fileWhile Perry argues evidence should have been needed to evict her from her home, for rental disputes, evidence isn’t always required or available.
“It’s quite vague,” said Sandiford. “Quiet enjoyment is not defined any further. What counts as a violation of quiet enjoyment is almost entirely up to the rental office’s discretion.”
