Kimberly Woolman was charged with causing a disturbance and assaulting two employees at a Save\u002DOn\u002DFoods store in Campbell River on April 24, 2020.
At one point, Woolman turned around to face Poulton, who had been following her trying to get her to leave the store and was about a metre away, and forcibly coughed in the direction of her face, twice.The woman’s actions were “jarring,” Sean Cleaver told the court, and not knowing whether she was sick or contagious at the time “put people on edge.”
That view later evolved, noted the judge, which resulted to changes in public health orders, but at the time, masks were not yet mandated and social distancing was the primary recommendation from public health authorities to prevent the spread of COVID-19. Poulton said she was “shaken” after the incident and went home to shower and monitor herself for symptoms. She returned to work the next day.
