McCaw was arrested at his home after police discovered he was using email accounts to upload pornographic videos of boys aged one to 12, and had seven images and three videos on his computer. He pleaded guilty to one count of child porn possession. After he was charged the first time in 2000, he only attended a few counselling sessions with a psychologist. After he was sentenced to prison in 2011, he was sent to the St. Lawrence Valley Correctional Treatment Centre and the Royal Ottawa Secure Treatment Unit where was diagnosed with pedophilia and hebephilia.Article content
McCaw had been on bail for more than three years under house arrest conditions by the time he was sentenced by Maclure. His defence lawyer argued for a time-served disposition followed by three years of probation. The Crown wanted three years in prison. The appeal court said Maclure had been persuaded to give a two-year custodial sentence, with only six months of house arrest, because of McCaw’s challenges with mental health, his guilty plea and remorse, the gap in his record and his long house arrest bail.Article content
“Nowhere in the reasons did the sentencing judge address the respondent’s risk of reoffending or the gravity of the harm that could ensue if he was to serve his sentence in the community,” the appeal court said.
